Please read these terms carefully before using Kiko AI Order Taker.
1. Acceptance of Terms
By downloading, installing, or using Kiko AI Order Taker ("the App"), you ("User") agree to be legally bound by these Terms & Conditions. If you do not agree, do not use the App.
2. Description of Service
Kiko AI Order Taker provides: reading and processing call recording files stored on the user's Android device; AI-based transcription of call audio into text; extraction of order information (name, address, items, amounts) from transcripts; order review, editing, and management dashboard; and delivery of formatted orders to customers via WhatsApp. The App is intended for use by business owners, sellers, and their authorised staff.
3. User Eligibility
- You must be at least 18 years of age to use this App.
- You must be the authorised representative of the business for which you are using the App.
- By using the App, you represent that you meet these requirements.
4. User Responsibilities
By using Kiko, you agree that you will provide accurate and truthful information; you are responsible for maintaining account security; you will only process recordings for which you have the legal right; you will review all AI-extracted orders before sending to customers; and you will not use the App for any prohibited purpose.
5. Call Recording & Legal Compliance
Kiko processes call recordings stored on your device. The App does not record calls itself. You, the business user, are solely and completely responsible for:
- Ensuring you have obtained explicit or implied consent from the party being recorded, as required by law
- Complying with all applicable laws — including the Indian Telegraph Act, IT Act 2000 (as amended), and relevant state regulations
- Disclosing to customers that their calls may be recorded for order processing purposes
- Keeping records of consent where required by law
Kiko AI accepts no liability for any legal claims, regulatory penalties, or disputes arising from unauthorized call recording by the user.
6. AI Accuracy Disclaimer
Kiko uses AI-based transcription and natural language processing. This technology, while highly capable, is not perfect. Transcripts may contain errors due to accents, background noise, or overlapping speech. Extracted order details may be incorrect. Kiko does not guarantee 100% accuracy. Users must review every extracted order before sending it to customers. We are not liable for business losses, incorrect deliveries, or financial errors resulting from unverified AI output.
7. WhatsApp & Messaging Compliance
When using Kiko to send orders via WhatsApp, you agree to comply with WhatsApp's Terms of Service and Business Policy; you will not send spam or bulk promotional content; you will only send order-related messages that the customer has initiated; and you are responsible for any violations of WhatsApp's policies arising from your use.
8. Subscriptions & Payments
- Kiko offers free and paid subscription plans as described on the Pricing page.
- Paid plans are billed monthly or annually as selected.
- GST and applicable taxes will be charged as per Indian law.
- Subscriptions auto-renew unless cancelled before the renewal date.
- Subscription fees are generally non-refundable. Refund requests within 7 days of charge may be considered for documented service failures — email help@kiko.live.
- We reserve the right to change pricing with 30 days' prior notice.
9. Prohibited Use
You agree not to use Kiko to: record or process calls without legal authorisation or required consent; send spam, unsolicited messages, or fraudulent orders; impersonate any person or business; circumvent or hack any security measure; collect data without the subject's knowledge; or use the App for any purpose other than legitimate business order management.
10. Intellectual Property
All content, features, code, AI models, branding, and interfaces within the Kiko app are owned by or licensed to Kiko AI and are protected by applicable intellectual property laws. Users are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purposes. You may not copy, modify, reverse-engineer, or distribute any part of the App.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Kiko AI shall not be liable for: loss of business, revenue, or profits; incorrect order extraction or AI errors; missed orders due to technical failures; third-party service outages; legal penalties arising from unauthorized call recording by users; or any indirect, incidental, or consequential damages. Our maximum aggregate liability shall not exceed the amount paid by that user in the 3 months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Kiko AI, its team, affiliates, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising out of your violation of these Terms, unauthorized recording, misuse of extracted data, or violations of applicable law.
13. Suspension & Termination
We may suspend or terminate your account if you violate these Terms, we detect misuse or fraud, or non-payment of applicable subscription fees occurs. You may terminate your account at any time by requesting deletion via help@kiko.live. Upon termination, your data will be deleted as described in our Privacy Policy.
14. Governing Law & Disputes
These Terms shall be governed by the laws of the Republic of India. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of competent courts in India.
